FDA Loses Tobacco Battle

Striking a major blow to the president’s anti-smoking campaign, the Supreme Court today ruled that the government lacks the power to regulate tobacco as an addictive drug. In a five-to-four ruling, the justices said the Food and Drug Administration’s controversial efforts to crack down on cigarette sales to minors went too far. For the majority, Justice Sandra Day O’Connor wrote that Congress has clearly said the FDA doesn’t have jurisdiction over tobacco products.
